The American constitution is the written version and as stated before it is one document that describes the constitution in its entirety. This constitution is the key to the America’s federal system, which was focused on checks and balances and a key factor was creating local power systems in its states. The constitutional writers did not want a constitutional monarchy or a government reminiscent of Britain; they instead adopted some of the theories of French political theorist Montesquieu, who advocated a separation of powers[1]. The constitutional fathers were attempting to set up a government that would be free of corruption. As Lord Acton stated a century later, “power corrupts and absolute power corrupts absolutely”[2], thus they set up legislative, executive, and judiciary branches which were separate from one another. Even though they had separated the powers between the different branches they also instituted checks and balances where laws enacted in the House of Representatives had to gain approval in the Senate, once obtained in the Senate it was presented to the President who had the right to veto the legislation; on the other hand congress had the right to cut off funds to the executive[3]. The Judiciary Branch has the power to declare new legislation unconstitutional and keeps the other branches in check[4]. The founding fathers wanted to fragment power even further and created regional or state governments which are able to enact their own legislation for their own region which fractured government even further. A Bill of Rights was added a few years later with the purpose of protecting the citizens from the government.
